Welcome to the website of Feed the Soul (FTS Charity) ("Feed the Soul," "FTS," "we," "us," or "our"). These Terms and Conditions govern your access to and use of our website, online materials, programs, services, resources, and other content made available through this website.

By accessing or using this website, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use this website.

1. About Feed the Soul

Feed the Soul is a nonprofit organization dedicated to improving access to fresh fruits and vegetables, nutrition education, healthy habits, and opportunities that help children, families, and communities thrive.

Our website provides information about our charitable programs, educational initiatives, community activities, partnerships, volunteer opportunities, fundraising efforts, events, and other activities of Feed the Soul.

Information about our programs is provided for educational and informational purposes and does not create a contractual relationship between Feed the Soul and any website visitor unless expressly stated otherwise in a separate written agreement.

2. Ownership of Website Content and Intellectual Property

All content appearing on this website is owned by, licensed to, or used with permission by Feed the Soul unless otherwise specifically identified.

This includes, without limitation:

  • Program descriptions;

  • Educational materials;

  • Curriculum and lesson plans;

  • Worksheets and activity sheets;

  • Program manuals and guides;

  • Training materials;

  • Program models and program documentation;

  • Social-media content created by Feed the Soul;

All rights are reserved by Feed the Soul unless otherwise expressly stated.

Original text, photographs, graphics, artwork, videos, curriculum, and other creative works may be protected by United States copyright law. Copyright protection generally attaches when an original work is fixed in a tangible form; registration is not required for copyright protection.

3. Feed the Soul Programs and Program Materials

Feed the Soul has developed and/or operates proprietary programs, educational initiatives, curricula, resources, systems of delivery, program materials, branding, and other intellectual property.

These include, without limitation, programs and initiatives associated with:

  • Power of Produce (POP)

  • To The Rescue

  • Eat Great 2B Great

  • Cultivating Calm

  • Level the Field

  • Healthy Holidays

  • Grow Where You Are Planted

  • and other Feed the Soul programs, curricula, educational resources, and initiatives now existing or developed in the future.

The names, logos, written materials, curriculum, manuals, graphics, photographs, videos, educational resources, program documentation, and other original materials associated with these programs may constitute protected intellectual property of Feed the Soul.

Nothing on this website grants any person or organization a license, ownership interest, or other right to reproduce, adapt, distribute, commercialize, teach, implement, license, sell, publish, or otherwise use Feed the Soul's proprietary program materials without Feed the Soul's prior written permission.

Viewing our programs or materials on this website does not give you permission to copy or reproduce them.

Feed the Soul expressly reserves all rights not granted in these Terms and Conditions.

4. No Unauthorized Copying or Replication of Programs

You may not, without the prior written consent of Feed the Soul:

  • Copy, reproduce, publish, distribute, or republish Feed the Soul curriculum or educational materials;

  • Copy or reproduce Feed the Soul program manuals, guides, planograms, worksheets, training materials, or other proprietary resources;

  • Use Feed the Soul materials to create a substantially similar competing program;

  • Remove copyright, trademark, attribution, or other ownership notices;

  • Modify Feed the Soul materials and present them as your own;

  • Use Feed the Soul's program names or branding in a manner that suggests sponsorship, affiliation, endorsement, or authorization;

  • Sell, license, sublicense, distribute, or commercially exploit Feed the Soul materials;

  • Upload Feed the Soul materials to another website, database, platform, artificial-intelligence system, repository, or file-sharing service; or

  • Represent Feed the Soul's original program materials or curriculum as having been created by another person or organization.

Feed the Soul reserves the right to take appropriate legal action against unauthorized use, reproduction, distribution, misappropriation, or other infringement of its intellectual property rights.

Feed the Soul names, logos, program names, slogans, graphics, and other branding elements may constitute trademarks, service marks, trade names, or other proprietary identifiers of Feed the Soul or its partners.

Nothing contained on this website grants permission to use any Feed the Soul trademark, logo, program name, or other branding without prior written authorization.

You may not use Feed the Soul's name, logo, program names, or other identifying marks in a way that could cause confusion about affiliation, sponsorship, endorsement, partnership, or authorization.

7. Photographs, Videos, and Images

Feed the Soul reserves all rights in photographs, videos, graphics, and other visual content appearing on this website unless otherwise indicated.

Many photographs and videos are taken in connection with Feed the Soul's programs, events, distributions, educational activities, volunteers, partners, and community activities.

You may not download, reproduce, alter, publish, distribute, sell, license, or otherwise use Feed the Soul photographs, videos, or images for personal, commercial, fundraising, promotional, political, organizational, or other purposes without prior written permission.

Feed the Soul may modify, suspend, or discontinue a program, event, distribution, or activity at any time when operational, safety, funding, weather, facility, governmental, community, or other circumstances require.

11. Third-Party Organizations and Partners

Feed the Soul works with schools, farms, nonprofits, businesses, governmental entities, community organizations, volunteers, donors, and other partners.

Mention of an organization, business, product, service, school, farm, or other third party on this website does not necessarily constitute an endorsement, sponsorship, or guarantee by Feed the Soul.

Likewise, unless expressly stated otherwise in a written agreement, a third party's participation in or partnership with Feed the Soul does not create a legal agency, employment, joint venture, or ownership relationship.

12. Donations and Contributions

Donations made to Feed the Soul are intended to support our charitable mission and programs.

Unless otherwise specifically stated, donations are generally made to Feed the Soul for charitable purposes and may be used where the organization determines the funds are most needed to advance its mission.

A donation does not give the donor ownership of Feed the Soul, its programs, intellectual property, curriculum, materials, or other assets.

Where required by law, tax receipts or acknowledgments may be provided.

13. Volunteers

Participation as a Feed the Soul volunteer may require completion of additional registration, waivers, background checks, training, school requirements, safety requirements, or other conditions depending on the activity.

Volunteer participation does not create an employment relationship unless expressly established in a separate written agreement.

14. User-Submitted Content

If you voluntarily submit photographs, comments, testimonials, stories, suggestions, ideas, applications, feedback, or other materials to Feed the Soul, you represent that you have the right to submit those materials and that doing so does not violate another person's rights.

By voluntarily submitting content for potential publication or organizational use, you grant Feed the Soul permission to use, reproduce, edit, publish, display, distribute, and otherwise use that content for legitimate nonprofit, educational, charitable, fundraising, marketing, communications, and informational purposes, unless otherwise agreed in writing.

Feed the Soul is not obligated to publish or use any submitted content.

15. Prohibited Activities

You agree not to use this website:

  • To violate another person's rights;

  • To impersonate Feed the Soul or another individual or organization;

  • To misrepresent an affiliation with Feed the Soul;

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Feed the Soul serves children and families through its charitable programs. Our website is not intended to collect personal information from children without appropriate authorization or consent.

Where Feed the Soul photographs, videos, or otherwise features children participating in programs or events, such activities are subject to applicable permissions, releases, school policies, parental/guardian consent requirements, and organizational procedures.

Feed the Soul reserves the right to modify these Terms and Conditions at any time.

Changes will become effective when posted on this website unless a different effective date is stated.
